Burbank Adopts an Uncodified Ordinance to Cap Commission Rates for Third-Party Food Delivery Services

Burbank, CA (April 1, 2021) – The Burbank City Council adopted an uncodified ordinance to cap commission rates for food delivery and non-delivery related service to assist in the reopening of businesses impacted by COVID-19. 

The uncodified ordinance caps third party delivery fees to restaurants at 15% of the online purchase price and 5% for additional services. This ordinance also requires detail receipts to the restaurant and end consumer, as well as prohibiting a decrease in compensation to a delivery person due to this cap. This temporary ordinance pertains to food delivery within Burbank only, and ends 90 days after the County’s Health Officer Orders and the State Orders allow for indoor dining and outdoor dining at 100% capacity unless terminated sooner or extended by the City Council.

“With Burbankers turning more to food delivery during the pandemic, temporarily capping the commission rates for third-party food delivery services will provide some economic relief for our Burbank restaurants,” said City Manager Justin Hess.
