Burbank City Council Extends Three Urgency Orders in Response to the COVID-19 Pandemic

Burbank, CA (December 22, 2020) – The Burbank City Council approved extending three urgency orders in response to the COVID-19 Pandemic. These include, extending the Urgency Eviction Ordinance applying only to commercial tenants, extending the urgency ordinance to facilitate for outdoor operations for dining and gyms, and authorizing the continued closure of parts of San Fernando Boulevard and extension of Outdoor Dining permits.

Extending the Local Commercial Eviction Moratorium until March 31, 2021

The Burbank Eviction Ordinance does not forgive the payment of rent, but rather acknowledges a commercial tenant is still obligated to pay any missed rent as deferred payments.   Any deferred rent will be due six months after the end of the expiration of the Ordinance.  The approved Ordinance expires March 31, 2021, unless extended again.  This means all deferred rent would be due on September 30, 2021.  Additionally, the Property Owner may not charge or collect interest, late fees or other penalties that could accrue on unpaid rent through the end of the six-month grace period.  Residential evictions continue to fall under State legislation AB 3088.

The City Council continues to encourage both residential and commercial tenants to pay any portion of the rent they can afford, to speak with the landlords and if possible, work out a repayment plan.

Extending the Urgency Ordinance Temporarily Allowing Outdoor Dining and Other Services in Private Parking Lots until June 30, 2021

This ordinance will allow restaurants to continue to provide outdoor dining immediately after the State and County Health Orders are lifted and will facilitate the uses for other businesses restricted to outdoor operations when reopening is allowed. Gyms and churches are still allowed to operate outdoors.

Extension of Urgency Use of Private Parking Lot Ordinance 20-3,949

Extending Sidewalk Dining through June 30, 2021

Upon liftings of State and County Health Orders restricting outdoor dining, this resolution will allow outdoor dining in the public right of way to resume immediately and extends any permits through June 2021 that were to expire earlier.  The resolution will also allow for the closure of parts of San Fernando Boulevard as necessary.
