Changes to Eviction Protections Effective October 1st

State of California Residential Eviction Order Update

The CA State Residential Eviction Order is set to expire September 30, 2021. This law supersedes local eviction orders and put in place temporary protections for residential renters unable to pay rent due to the COVID-19 pandemic.  Eligible residential tenants impacted by COVID-19 may be able to rely on the Los Angeles County’s emergency moratorium but ultimately, in an eviction action, a court will decide.

 

With the state residential eviction order ending, beginning October 1, 2021, landlords may proceed with eviction proceedings for past due rent.  Therefore, it is urgent that residential tenants protect themselves from eviction for unpaid rent due to COVID-19 hardship by applying to the State Rental Assistance program at Housingiskey.com.  The California COVID-19 Rent Relief program is an official State of California sponsored program.  Households can get up to 100% of their rental debt paid.  Apply now at HousingIsKey.com or call (833) 430-2122; before eviction protections end on September 30, 2021.

LA County Eviction Order Update

LA County Board of extended the LA County eviction order that protects residential rents and certain commercial tenants to January 2022.  Under this order, Burbank commercial and residential tenants may have protections under the county ordinance, but that decision will be determined by the courts. 

 

City of Burbank Commercial Eviction Order Update

The City of Burbank Commercial eviction ordinance that protected certain commercial tenants from eviction for the non-payment of rent caused by COVID-19 is also set to expire on September 30, 2021.  Eligible commercial tenants impacted by COVID-19 may also be able to rely on the Los Angeles County’s emergency moratorium but ultimately, in an eviction action, a court will decide. 

 

Eligible commercial tenants that were protected from eviction via the City commercial eviction moratorium have six (6) months from the expiration of the City’s commercial order (September 30, 2021) to pay back due rent; until March 31, 2022.  For more information on the rent repayment period and commercial tenant resources, please visit the City’s COVID-19 website at burbankca.gov/business-resources.
