AFFORDABLE HOUSING AGREEMENT REQUIREMENTS

Burbank’s Inclusionary Housing Ordinance (Burbank Municipal Code (BMC) Sections 10-1-644 through 10-1-653) applies to all projects involving new construction of five (5) or more residential dwelling units. At least fifteen (15) percent of all newly constructed dwelling units in Residential Developments shall be sold or rented to Very Low-, Low- and Moderate-Income Households, at an Affordable Rent or Affordable Ownership Housing Cost.

  • For-Sale Projects – Fifteen (15) percent of the total Residential Development shall be sold to Low and/or Moderate-Income Households.
  • Rental Projects - A minimum of five (5) percent of units in the total Residential Development shall be Very Low Income; the remaining ten (10) percent of the units shall be Low Income.

DEVELOPER’S RESPONSIBILITY

  • Complete an Affordable Housing Agreement (AHA) and record the AHA against the title of the property prior to issuance of any building permit. 

  • Pay a fee to cover City expenses for drafting and recording the AHA as authorized by the City of Burbank fee schedule under Article III Land Use and Zoning, and Article I, Section 14

  • Submit a Marketing Tenant/Buyer Selection plan for City review and approval prior to issuance of Certificate of Occupancy.
