Application Forms & Fees

All applications must be filled out completely and submitted with applicable fees. If your project requires more than one application, you may fill out the General Application once, however all supplemental applications must be completed as required. For all applications requiring plans, the plans must follow the Standard Plan Formatting Guidelines. Please note that applications submitted without fees will not be processed untilt he required payment has been submitted.

PLANNING PERMIT APPLICATIONS
1) SB 35 Notice of Intent (NOI) Application    2) Streamlined Ministerial Review Process Application
  • Fee - $22,011.57

California Senate Bill 35 (2017) created a streamlined and ministerial approval process for certain housing projects under Government Code §65913.4. The California Housing and Community Development Department (HCD) has prepared guidelines that further explain the requirements of Government Code §65913.4., which can be accessed at the following link:  https://www.hcd.ca.gov/policy-research/docs/sb-35-guidelines-update-final.pdf


Invocation of SB 35 streamlining must be initiated by the project applicant and is subject to the eligibility restrictions listed in the SB 35 Supplmental Application - Eligibility Checklist.
   
Applicants intending to invoke the SB 35 streamlining and ministerial approval process must fill out the SB 35 Notice of Intent (NOI) Application and Eligibility Checklist completely and provide a full set of project plans (i.e., site plan, floor plan, demolition plan, elevations, building cross-sections, and conceptual landscape and civil plans - See Standard Plan Details & General Requirements), and supporting documentation for each question, as applicable, to demonstrate eligibility, along with the required NOI and Tribal Consultation application fee.  Incomplete checklists that do not include required attachments or supporting documentation will not be processed and the request will be deemed incomplete.   In addition to reviewing the NOI application for completeness and eligibility for the streamlined ministerial process, the City will start the Tribal Consultation Process as required by Government Code Section 65913.4(b), within 30 days of the filing of the NOI.

The NOI process will be complete once 1) the Director deems NOI checklist materials complete; and 2) the Tribal Consultation is completed pursuant to Government Code Section 65913.4, subsection (b).  City Staff will provide a NOI - Completeness Letter to the applicant. 

After completing of the NOI process an applicant may submit an application for Streamlined Ministerial Review Process Application to the City. In addition to this application form, the applicant must submit the NOI Completeness Letter, Updated Project Plans, Eligibility Checklist Items demonstrating the Project's compliance with SB35 Eligibility Critieria, and a table/matrix demonstrating the proposed project’s compliance with the all objective standards. Staff will review the submittal materials forward a report of findings of consisntency with said objective standards to the City Council.

The City Council, at a noticed public meeting, shall undertake ministerial design review and public oversight as provided for in California Government Code Section 65913.4(d). City Council review shall include review of the Community Development Director’s determination.  Furthermore, the City Council’s review under this process shall be objective and strictly focused on the project’s compliance with the criteria required for a streamlined project pursuant to the California Government Code Section 65913.4 and consistency with City reasonable objective zoning standards, objective subdivision standards, and objective design review standards applicable to the project, which have been adopted prior to the applications submittal to the City and are applicable to other developments within the City.

Streamlined Ministerial Review Process Application

Government Code Sections 65912.100 – 65912.140, also known as Assembly Bill 2011 (AB 2011), require the City to review qualifying housing development projects using a streamlined ministerial review process. Eligible projects must comply with objective planning standards, provide specified levels of affordable housing, and meet other specific requirements, as detailed in this application in the AB2011 Supplemental Application - Eligibility Checklist.

Applicants intending to invoke the AB 2011 Streamlined Ministerial Review approval process must complete the Steamlined Ministerial Review Process Application and AB2011 Supplmental Application - Eligibility Checkslist and  provide supporting documentation for each item (as applicable) to demonstrate eligibility. Additional materials include project plans (i.e., site plan, floor plan, demolition plan, elevations, building cross-sections, and conceptual landscape and civil plans - See Standard Plan Details & General Requirements), a Table/Matrix demonstrating compliance with all objective design and development standards, and a Phase I Environmental Site Assessment (ESA). The Planning Division will review the submitted materials and make a determination on whether the proejct complies with AB2011 criteria and forward the determination to the City Council for Council consideration as part of the ministerial design review, as outlined in subsection (C) of Section 10-1-19302 of the Burbank Municipal Code.

Appeal Form (PDF)

An appeal may be filed the following business day from the decision date (noted on the decision letter or the date of the public hearing). Most appeals must be filed within 15 calendar days of the date the decision is made or public hearing date. To confirm the appeal period, please contact the Project Planner at (818) 238-5250. No appeal can be filed after the appeal deadline.   
 

If Multiple Appeals or Appellants

If more than one appeal is filed on a single project, all appeals will be heard together at a single public hearing. If a person decides to withdraw their appeal and only one appeal was filed, there will be no public hearing.

If multiple individuals wish to appeal a decision for the same reasons, the individuals may file a single appeal form with each individuals signature and share the cost of the appeal. For such an appeal to be withdrawn, all persons who signed the original appeal form must submit a written request to withdraw the appeal.

Planning application fees are approved by the City Council each year and become effective on July 1st in conjunction with adoption of the City budget. All Planning Application fees are due at the time of application submittal. Planning application fees include fees charged for application review by other City Departments, such as Public Works. 

Payment of fees may be provided by cash, check (made payable to the "City of Burbank"), or credit card (Visa or MasterCard). For credit card transactions, an administrative fee of 3% per transaction will be charged.
