All applications must be filled out completely and submitted with applicable fees. If your project requires more than one application, you may fill out the General Application once, however all supplemental applications must be completed as required. For all applications requiring plans, the plans must follow the Standard Plan Formatting Guidelines. Please note that applications submitted without fees will not be processed untilt he required payment has been submitted.
Before submitting an application, please contact the Planning Division to confirm application submittal requirements.
Invocation of SB 35 streamlining must be initiated by the project applicant and is subject to the eligibility restrictions listed in the Notice of Intent (“NOI”) application.
Applicants intending to invoke the SB 35 streamlining and ministerial approval process must fill out this NOI checklist completely and provide a full set of project plans (i.e., site plan, floor plan, demolition plan, elevations, building cross-sections, and conceptual landscape and civil plans), and supporting documentation for each question, as applicable, to demonstrate eligibility, along with the required NOI and Tribal Consultation application fee. Incomplete checklists that do not include required attachments or supporting documentation will not be processed and the request will be deemed incomplete. In addition to reviewing the NOI application for completeness and eligibility for the streamlined ministerial process, the City will start the Tribal Consultation Process as required by Government Code Section 65913.4(b), within 30 days of the filing of the NOI.
After the applicant files the NOI application, the Community Development Director shall submit the NOI to the City Council within sixty (60) days of receipt of the NOI for City Council consideration of the proposed projects compliance with the site eligibility requirements as noted in Section 65913.4, subsections (a)(2)(A-C).
The development and the site on which it is located satisfy all of the following:
(A) It is a legal parcel or parcels located in a city if, and only if, the city boundaries include some portion of either an urbanized area or urban cluster, as designated by the United States Census Bureau, or, for unincorporated areas, a legal parcel or parcels wholly within the boundaries of an urbanized area or urban cluster, as designated by the United States Census Bureau.
(B) At least 75 percent of the perimeter of the site adjoins parcels that are developed with urban uses. For the purposes of this section, parcels that are only separated by a street or highway shall be considered to be adjoined.
(C) It is zoned for residential use or residential mixed-use development, or has a general plan designation that allows residential use or a mix of residential and nonresidential uses, and at least two-thirds of the square footage of the development is designated for residential use. Additional density, floor area, and units, and any other concession, incentive, or waiver of development standards granted pursuant to the Density Bonus Law in Section 65915 shall be included in the square footage calculation. The square footage of the development shall not include underground space, such as basements or underground parking garages.
The NOI process will be complete once 1) the City Council reviews and approves the Project’s site eligibility criteria; 2) the Director deems NOI checklist materials complete; and 3) the Tribal Consultation is completed pursuant to Government Code Section 65913.4, subsection (b).
After completing of the Notice of Intent to submit an application for Streamlined Ministerial Approval process and the Tribal Consultation process an applicant may submit an application for Streamlined Ministerial Approval Processing to the City. The applicant must submit a building permit application and an SB 35 streamlined ministerial approval process application demonstrating the proposed project’s eligibility under California Government Code Section 65913.4.
The City Council, at a noticed public meeting, shall undertake ministerial design review and public oversight as provided for in California Government Code Section 65913.4(d). City Council review shall include review of the Community Development Director’s determination. Furthermore, the City Council’s review under this process shall be objective and strictly focused on the project’s compliance with the criteria required for a streamlined project pursuant to the California Government Code Section 65913.4 and consistency with City reasonable objective zoning standards, objective subdivision standards, and objective design review standards applicable to the project, which have been adopted prior to the applications submittal to the City and are applicable to other developments within the City.
The City Council’s review and a final determination on whether an application complies with the criteria under California Government Code Section 65913.4 and the reasonable objective zoning standards, objective subdivision standards, and objective design review standards applicable to the project must be completed in 90 days for projects with 150 or fewer units and 180 days for projects with more than 150 units, measured from the date of the application submittal.

If more than one appeal is filed on a single project, all appeals will be heard together at a single public hearing. If a person decides to withdraw their appeal and only one appeal was filed, there will be no public hearing.
If multiple individuals wish to appeal a decision for the same reasons, the individuals may file a single appeal form with each individuals signature and share the cost of the appeal. For such an appeal to be withdrawn, all persons who signed the original appeal form must submit a written request to withdraw the appeal.
Planning application fees are approved by the City Council each year and become effective on July 1st in conjunction with adoption of the City budget. All Planning Application fees are due at the time of application submittal. Planning application fees include fees charged for application review by other City Departments, such as Public Works.
Payment of fees may be provided by cash, check (made payable to the "City of Burbank"), or credit card (Visa or MasterCard). For credit card transactions, an administrative fee of 3% per transaction will be charged.
